Since the governor of Arizona Jane Brewer signed the law SB1070 last week, has been thousands of declarations everywhere of US, press conferences, small riots, protests and the whole nine yards but, let’s sit down for a moment to analyze what this law truly means.

S.B 1070.

Purpose:

Requires officials and agencies of the state and political subdivisions to fully comply with and assist in the enforcement of federal immigration laws and gives county attorneys subpoena power in certain investigations of employers. Establishes crimes involving trespassing by illegal aliens, stopping to hire or soliciting work under specified circumstances, and transporting, harboring or concealing unlawful aliens, and their respective penalties.

Background:

Federal law provides that any alien who 1) enters or attempts to enter the U.S. at any time or place other than as designated by immigration officers, 2) eludes examination by immigration officers, or 3) attempts to enter or obtains entry to the U.S. by a willfully false or misleading representation is guilty of improper entry by an alien. For the first commission of the offense, the person is fined, imprisoned up to six months, or both, and for a subsequent offense, is fined, imprisoned up to 2 years, or both (8 U.S.C. § 1325).

The U.S. Immigration and Customs Enforcement (ICE) is the primary authority for enforcing immigration laws. ICE was created in March 2003 as an investigative branch of the Department of Homeland Security. ICE was the result of combining the Immigration and Naturalization Service and the U.S. Customs Service.

Current statute defines criminal trespass in the first degree as a person knowingly entering or remaining unlawfully in areas related to residential structures, residential yards, real property subject to a valid mineral claim or lease under certain circumstances, property if the person defaces religious symbols or religious property, or critical public service facilities. Depending on the circumstances, criminal trespass in the first degree provides penalties ranging from a class 1 misdemeanor to a class 6 felony (A.R.S. § 13-1504).

In 2007, Arizona enacted the Legal Arizona Workers Act (LAWA), prohibiting an employer from knowingly or intentionally employing an unauthorized alien and establishing penalties for employers in violation. The U.S. Citizenship and Immigration Services office administers the Systematic Alien Verification for Entitlements (SAVE) Program. The SAVE Program, together with the Social Security Administration (SSA), administers E-Verify, which allows employers to electronically confirm the employment eligibility of all newly hired employees. LAWA requires all Arizona employers to use E-Verify to verify the employment eligibility of new hires. Proof of verifying the employment authorization of an employee through E-Verify creates a rebuttable presumption that an employer did not intentionally or knowingly employ an unauthorized alien.

So,what part of the law this people don’t understand? Whoever illegally trespass (your backyard, property or US Border) is a criminal, and should be prosecute, I don’t care if is Mexican, Chinese or Russian.

In the other hand the Mexican government, which so euphorically has been pronounced against this law, and in defense of his citizens is the first one in closing the borders to the illegal immigrants of Guatemala, Honduras, El Salvador and even of Nicaragua and Panama and it has no problem in repatriating them to their countries, including Cuban rafters who arrive to the Mexican coasts fleeing of the communist regimen of the Castro brothers in Cuba.

Let’s take a look on what the Mexican law said about Illegal immigrants.

The article 123 of the General Law of Mexican Population (LGP).

“Sanctions will be imposed for up to two years in prison and it fines from 300 to 5000 pesos abroad that enter illegally to the country “.This disposition, which has remained current for 34 years, it is sufficient to affirm that in Mexico the undocumented immigration is considered to be a crime. And the crime is sanctioned by jail and fines.
Not only is the immigrant who penetrates in the country without documents are penalized: the articles of 118 to 125 of the LGP establish the sanctions related to the legal immigrants.
There is physical and economic penalties for the one who, having been repatriate, re-enter again to the country without documents; for whom it remains in Mexico beyond the authorized time; for the one that realizes activities different from those that it mentioned when it entered to the country; and for whom it is shown by a migratory quality different from the one that the Secretary of Government granted him.
The sanctions go from 18 months to10 years of jail”.

Well, the Mexican government can close his borders to the "illegal ones", WE CAN’T?.

Confused? , well don’t be, since almost 100 % of the national economy of Mexico simply bases on the "remittances" of millions of dollars that the Mexican immigrants send to their families every year.

The United States has never closed his doors to the immigrants ... legal, of course, this country has opened his doors to million of immigrants not only Mexican, but from the whole world, the foundations of this great nation is founded on the immigration, but also it is a country of laws, and these are not exempt for anybody, Mexican, Chinese or African. The United States is an immigrants' nation. Successful waves of (legal) immigrants have supported to this demographically young country, have enriched his culture and have contributed to the productive capacity of the nation, increasing his influence in the world.

On the other hand we have the double faces of representatives, senators or simply aspirants to some public position (all the Latin ones), go out in defense of the immigrants and against this law ... (the immigrations laws has always been in the constitution of the US), they are really interested in the topic of the immigrants?.

I do not believe so, this is only POLITICAL crap, let's remember something in November there will be elections in the states to where these "POLITICIANS" belong, trying to gain the Hispanic vote, I really want to see if after the November elections they will keep talking and pleading against the immigration law.

And I don’t want to talk about the Millions of dollars lost in Taxes every year, since this people DON’T PAY TAXES, that issue I leave it to the economists, and the IRS.

To finish this note I leave to you a fragment of the speech of the ex-president Vicente Fox back in November, 2003, and judge for yourself.

… if we reach the number (of remittances) that is estimated for this year, we will be already speaking about the higher revenue to our country; more than the oil, more than the tourism, more than the foreign investment. That God pays them fully, because our families make an excellent use of this money.

United States of America has all the rights to protects their borders and their citizens, like any other country in the world.
In other words “we are giving them a scoop of their own medicine” and this is the way I see it…
